First -- I have heard absolutely zero from Cooks Source -- however, HELLO INTERNET!! NICE TO SEE YOU!! Welcome to my blog!!

Hi: I recommend you write to Angela Hoy of WritersWeekly. She investigates deadbeat publishers and publishes the results of her investigations in her Whispers & Warnings column. angela@writersweekly. You don't need to mention my name, but I am Scott Rose. Best of luck! At the very least, Angela will help to publicize what this unethical publisher has done to you. But, she might even be able to get you paid.

Wow, do not tempt the Internet, for their wrath is mighty.

For the record, I'm also an editor, although of technical books, and after hearing about it from Scalzi, I have posted about your situation as well. I just wanted to assure you that I don't know of any editors who would consider such actions justifiable. I'd be tempted to apologize on behalf of all editors everywhere, but this person has forfeited the right to that title.

Illadore, I just saw your post. Wow.

I am a magazine editor. Real editors know what copyright is, and we know that "online" does not mean "public domain."

I also know that if I or someone working on my magazine made such an error, I'd apologize profusely, make that donation, and consider myself damn lucky. $130 is less than I pay for any of the stories I comission. To get out of a legal jam for that little would be a dream come true!

There are some sleazy publications out there. And they need to be called out for their behaviour.

Just bang in a DCMA to Google and put claim in through the small claims process. Don't forget to add costs and expenses to the bill.

Is she a member of a professional association. You could make complaint there.

It doesn't look like Cooks Source is incorporated or has any money (the phone number is registered to an apartment). So, good luck suing. Instead.. just make sure everyone is aware of the situation.

Her distribution points are listed on their website. The local ones (Sunderland, MA) are:

Bridge St Grill
Millstone
Bub’s BBQ

And then pick up a copy of the magazine, if you can, and contact the advertisers. I'm sure they will want to be affiliated with copyright theft.

If the magazine isn't incorporated, the editor is personally liable in the face of suit. A cheesy little assetless magazine corporation can throw up its hands, declare bankruptcy, and the plaintiff is pretty much screwed with respect to recompense. But as an individual (or let's use the Adams-esque 'induhvidual') can't do that - or rather, pretty much all her personal assets are at risk. IRAs, second car, etc, etc.

Let's all say it in unison, folks: "MORON!"

I hope you get compensated, or otherwise, I hope you will sue them into oblivion for their neglect!

Please, please, PLEASE consult a lawyer. No lawyer will give you legal advice over the internet, but based on the limited information I've seen, this would be a very easy case to win. That's good for you and the attorney... make some calls and see someone.

Honey, did you attend Columbia? If yes, isn't there an adviser or mentor you could contact for advice on how to proceed? Maybe the school can back you? Maybe they can use you as a story subject for the Columbia Journalism Review? Or maybe Poynter will catch wind of this, too.

Maybe you should knock on Columbia's and Poynter's doors with your case. It's a more civilized and forceful option than hate messages on their social media pages. And the proper appeal channels and pressure from professional organizations are a better option than yelling, vandalizing, and savagery by angry followers. You have your author's name to protect from that, too.

Finally, I love that you asked for compensation to take the form of a donation to Columbia. But I think you undersold yourself. Ten cents a word is the rate of a story mill like Demand Studios or Examiner. I think you should have asked for $1 a word. : ) Keep your standards high.

At least one of their advertisers has canceled their contract.
